These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “Customer,” or “you”) and Electron Blue, LLC (“Company,” “we,” “us,” or “our”), governing your access to and use of the WeBooked.ai voice agent platform and associated services (“Services”). By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, you must discontinue use of the Services immediately.
1. Definitions
For the purposes of these Terms:
“Services” refers to the WeBooked.ai platform, including features for automated call handling, appointment scheduling, and reporting tools.“Account” means the unique registration that allows access to the Services.“Confidential Information” refers to proprietary or sensitive information exchanged between the parties under these Terms.“Inbound Calls” refers to calls that our service WeBooked.ai answers on behalf of the User to answer to third parties.“Subscription” means the recurring payment arrangement granting access to the Services.“AI Agent” refers to the artificial intelligence instance configured to perform tasks on behalf of the User.
2. Eligibility
The Services are intended solely for users who are at least eighteen (18) years of age. By using the Services, you represent and warrant that you meet this age requirement and have the full authority, right, and capacity to enter into this agreement. If you are using the Services on behalf of an entity, you confirm that you have the authority to bind the entity to these Terms.
3. Account Registration and Security
To access the Services, you must register for an Account by providing accurate and complete information. It is your responsibility to keep your account credentials secure and confidential. You agree to notify us immediately of any unauthorized access or use of your Account. We are not liable for any loss or damage arising from your failure to maintain the confidentiality of your account credentials. You may not share your Account or allow any unauthorized person to use it.
4. Services Provided
The WeBooked.ai platform offers a range of AI-driven features designed to enhance customer interactions and streamline business operations. These include: • Inbound Call Management: Our AI agents handle incoming calls on behalf of your business, ensuring no call goes unanswered. • Outbound Call Services: The platform can initiate calls for purposes such as appointment reminders, follow-ups, or other business needs. • Customizable Call Workflows: Tailor call handling preferences and responses to align with specific business requirements. • Multilingual Support: Engage a diverse customer base with multilingual interaction capabilities. • Analytics and Reporting: Access detailed call logs, performance metrics, and insights to optimize your business operations.The specific features and capabilities of the Services may vary depending on the Subscription plan selected.
5. Subscription, Fees, and Billing
Access to the Services is provided on a Subscription basis, which may include recurring charges as outlined on our pricing page. You agree to pay all fees associated with your selected plan, including any applicable taxes. Subscription fees are billed in advance and are non-refundable unless otherwise stated in these Terms.Your Subscription will automatically renew at the end of each billing cycle unless canceled in accordance with these Terms. You authorize us to charge your payment method on file for all applicable fees. In addition to Subscription fees, you may incur usage-based charges, such as fees for extended call durations, which will be billed in arrears.We reserve the right to change our pricing or introduce new charges upon providing reasonable notice to you. If payment is not received on time, we may suspend or terminate your access to the Services.
6. Your Content
Content Ownership
You retain ownership of all content, data, and materials that you upload, submit, or otherwise provide through the Services (“Your Content”). This includes any text, audio, graphics, video, or other media shared with or processed by the platform.By submitting Your Content to the Services, you grant Electron Blue, LLC a worldwide, non-exclusive, royalty-free, sublicensable license to access, reproduce, modify, distribute, transmit, export, display, store, and otherwise use Your Content for the limited purposes of providing, improving, and supporting the Services.You represent and warrant that:
1. You own or have the necessary rights to submit Your Content and to grant us the licenses described above.
2. The use of Your Content as outlined in these Terms will not infringe or violate the rights of any third party, including copyrights, trademarks, privacy, or proprietary rights.
AI Inputs and Outputs
When you provide text, audio, or other materials to the Services (“Input”), the platform processes these Inputs to generate responses, transcripts, or other outputs (“Output”) using artificial intelligence technology.
• Ownership: You retain ownership of the Input and the resulting Output. Electron Blue, LLC assigns all rights, title, and interest in the Output to you, subject to the licenses described in this section.
• Content Usage for AI Training: You control whether your Input and Output may be used to improve the Services and underlying AI models. For more details or to modify your preferences, refer to our Privacy Policy.
WeBooked.ai makes no representations or warranties about the accuracy, completeness, or suitability of any Output generated by the Services. Outputs may contain inaccuracies or errors, and you should independently verify the information before relying on it.The platform is a tool designed to assist in decision-making and does not replace human judgment or expertise. You are solely responsible for any actions or decisions taken based on the Output.
Third-Party Outputs
Due to the nature of generative AI technology, Outputs generated by the Services may be similar or identical to those produced for other users. Outputs that derive from third-party Inputs (“Third-Party Outputs”) are not your property, and you have no rights to claim ownership over them.
Compliance
You are responsible for ensuring that Your Content and your use of the Services comply with all applicable laws, including data privacy and intellectual property laws.WeBooked.ai reserves the right to review, monitor, and remove Your Content to ensure compliance with these Terms. 7. User Responsibilities
By using the Services, you agree to:
• Ensure all calls made through the Services comply with applicable laws and regulations, including obtaining prior consent where required.
• Refrain from using the Services for any illegal, fraudulent, or abusive purposes.

• Comply with our Acceptable Use Policy, which prohibits spam, harassment, and misuse of the Services.
You acknowledge that you are solely responsible for the content of all calls, messages, or communications made through the platform.
8. Acceptable Use Policy
You may not use the Services to:
• Violate any local, state, national, or international law or regulation.
• Engage in fraudulent, deceptive, or harassing activities.
• Transmit malware, viruses, or any harmful content.
• Conduct spamming, phishing, or other unsolicited communications.
• Interfere with the functionality or security of the Services.
We reserve the right to suspend or terminate your access if you violate this policy.
9. Data Privacy and Confidentiality
You retain ownership of all data provided through the Services. By using the platform, you grant us a non-exclusive license to process your data solely for the purpose of providing and improving the Services. We are committed to protecting your information in accordance with our Privacy Policy.Both parties agree to protect each other’s confidential information and use it only for purposes related to these Terms. Confidential Information does not include information that is publicly available, independently developed, or lawfully obtained from a third party.
10. Intellectual Property
The WeBooked.ai platform, including its underlying technology, trademarks, and other proprietary materials, is owned by Electron Blue, LLC. You are granted a limited, non-transferable license to access and use the Services for your internal business purposes. You may not reverse-engineer, decompile, or attempt to derive the source code of the platform.
11. Limitation of Liability
The Services are provided “as is” without any warranties, express or implied. To the fullest extent permitted by law, Electron Blue, LLC shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Services. Our maximum liability for any claim related to the Services shall not exceed the amount you have paid in the twelve (12) months preceding the event giving rise to the claim.
12. Indemnification
You agree to indemnify and hold harmless Electron Blue, LLC and its affiliates from any claims, damages, losses, liabilities, demands, fines, or expenses of any kind arising from your use of the Services, including violations of these Terms or applicable laws.
13. Termination
We may suspend or terminate your access to the Services at any time for any reason, including non-compliance with these Terms. Upon termination, your right to access the Services ceases immediately. You may terminate your Subscription by providing written notice to us before the end of your billing cycle.
14. Modifications to the Services
We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time without liability to you.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of California. Any disputes arising under these Terms will be resolved through binding arbitration in accordance with the rules of American Arbitration Administration (www.adr.org).
16. Changes to Terms
We may update these Terms from time to time. Changes will be communicated to you via the platform or email. Continued use of the Services constitutes acceptance of the revised Terms.
